The Gardening Agency
1. Introduction
These Terms & Conditions (“Terms”) govern the services provided by The Gardening Agency (“we,” “our,” “us”) to clients (“you,” “your”) and subcontracted gardeners (“contractors”). By engaging our services, you agree to these Terms.

2. Services Provided
• We provide garden maintenance, clearance, and related services as agreed in advance.
• Services are carried out by vetted, self-employed subcontractors under our management.
• Specific services and frequencies will be agreed upon before work commences, via a quotation or maintenance plan.

3. Quotes & Pricing
• All quotes are valid for 30 days from the date of issue.
• Quotes are based on estimated labour hours and garden size.
• If additional work is required beyond the agreed scope, we will confirm revised pricing before proceeding.
• Our standard hourly rate is £36/hr unless otherwise agreed.
• Regular maintenance plans are billed monthly in advance.

4. Payments
• Invoices must be paid within 7 days of issue unless otherwise agreed.
• We reserve the right to suspend services if payments are overdue.
• Payments can be made via bank transfer or other methods specified on invoices.

5. Cancellations & Rescheduling
• Cancellations made with less than 48 hours’ notice may incur a fee equivalent to 50% of the scheduled job value.
• If we need to reschedule due to weather or other factors, we will notify you as soon as possible.

6. Client Responsibilities
• You must provide safe and reasonable access to the property and garden.
• Any pets or obstacles should be secured before work begins.
• If green waste disposal is not included in your plan, you are responsible for providing a suitable bin or waste solution.

7. Garden Waste & Materials
• Green waste disposal is charged separately at £40 per load unless included in your package.
• If you request additional materials (plants, compost, fencing, etc.), these will be invoiced separately.

8. Subcontracted Gardeners
• All gardeners engaged through The Gardening Agency are vetted and self-employed.
• We ensure they have the necessary skills and equipment for the job.
• They are not direct employees of the client. All scheduling and payment must go through The Gardening Agency.

9. Liability
• We will take all reasonable care in carrying out services, but we cannot be held liable for:
• Pre-existing damage to property or plants.
• Issues caused by pests, weather, or factors beyond our control.
• Our liability is limited to the cost of the service provided.
• We recommend clients maintain appropriate household insurance for their property and garden.

10. Termination of Services
• Either party may terminate services with 14 days’ written notice.
• For regular maintenance plans, any fees already paid for upcoming work are non-refundable.

11. Governing Law
These Terms are governed by the laws of England and Wales, and disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
